Good news for homebuyers (and the pros who serve them): most “trigger leads” are finally on their way out.
On September 5, 2025, the President signed the Homebuyers Privacy Protection Act (H.R. 2808). The new law reins in the practice of credit bureaus selling a borrower’s info the moment a mortgage credit pull happens—often leading to a flood of spam calls and texts. The law takes effect March 5, 2026. NARHousingWire
What changes in 2026
Starting March 5, 2026, credit bureaus cannot sell a mortgage shopper’s data unless one of these narrow exceptions applies:
Your current mortgage company (originator or servicer)
Your bank or credit union where you already have an account
You explicitly opt in (consent) to be contactedThese guardrails are now baked into federal law to curb abusive trigger leads and protect consumers. Financial Services CommitteeInman
Why this matters
Buying or refinancing a home is stressful enough. This law helps by:
Reducing unwanted calls/texts/emails after a credit check
Restoring control over who gets your information
Creating a fairer playing field for borrowers and ethical lenders alike HousingWireMortgage Professional
What you can expect before the effective date
Between now and March 5, 2026, the old rules still largely apply—but the end is in sight. Industry groups, consumer advocates, and regulators have welcomed the change, and lenders are preparing for the transition now. Dodd Frank UpdateInman
Bottom line
This is a win for privacy and a win for transparency. When you apply for a mortgage in 2026 and beyond, your information stays where it belongs—with you and the trusted financial partners you choose. NAR
